Waiver and Release Form

PARTICIPANTS MUST COMPLETE EVERY FIELD OF THE WAIVER AND RELEASE FORM.

PARENT/LEGAL GUARDIAN SIGNATURE IS REQUIRED IF PARTICIPATE IS UNDER AGE 18.

BEFORE ENROLLING IN ANY HEALTH AND FITNESS PROGRAM WE RECOMMEND YOU SPEAK TO YOUR HEALTHCARE PROFESSIONAL FOR APPROVAL.

I, _______________________________, have enrolled _______________________________ in the health and fitness program offered by Hollis A. Woodard and/or Operation CARE Inc. I understand and acknowledge that Hollis A. Woodard NOR Operation CARE Inc are certified aerobics instructors/facilitators, certified fitness trainers, physical therapy experts, nor do they have a degree in kinesiology or physiology. I recognize that the program may involve strenuous physical activity including, but not limited to, muscle strength and endurance training, cardiovascular conditioning and training, and other various fitness activities. I hereby affirm that I am in good physical condition and do not suffer from any known disability or condition which would prevent or otherwise limit my full participation in this physical program.

In addition, I am fully aware of the risks and hazards connected with the participation in the physical program including, but not limited to, physical injury or even death. I accept the risk and hereby elect to voluntarily participate in this program knowing that the associated physical activity may be hazardous to me and/or my property.

I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OR LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH, THAT MAY BE SUSTAINED BY ME, OR LOSS OR DAMAGE TO PROPERTY OWNED BY ME, AS A RESULT OF PARTICIPATIONIN THIS HEALTH AND FITNESS PROGRAM.

I hereby release, waive, discharge, and covenant NOT to sue Hollis A. Woodard, Operation CARE Inc. and/or any of its officers, servants, agents, consultants, volunteers, and/or employees from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury (including, but not limited to, death) that may be sustained by me, or to any property belonging to me, while participating in this program, or while on or upon the premises or via virtual platforms where the event is being conducted including, but not limited to, any claims arising out of the volunteer activities, even if caused by their ordinary negligence or otherwise.

It is my expressed intent that this waiver and release shall bind any and all members of my family including, but not limited to, my spouse, if I am alive, and my heirs, assigns, and personal representatives, if I am deceased. It is also my expressed intent that this waiver and release shall also be deemed a full release, waiver, discharge, and covenant not to sue insofar as my aforementioned family members, heirs, assigns, and personal representatives are concerned. I hereby further agree that this waiver and release shall be constructed in accordance with the laws of the State of Maryland and the state in which the fitness activities take place.

I also acknowledge that the Foundation has not arranged and do not carry any insurance of any kind for my benefit or that of participate (if participate is under 18), my parents, guardians, trustees, heirs, executors, administrators, successors, and assigns.

I also understand that this document is a contract which eliminates the liability of the Hollis A. Woodard and/or Operation CARE Inc.

In signing this waiver and release, I acknowledge and represent that I am of legal age, I have read and understand the foregoing, that by signing this form, I am giving up legal rights and remedies. and hereby sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreements have been made; and I hereby execute this waiver and release for valuable consideration, intending to be bound by the same.

PUBLICITY AND PHOTO CONSENT AND RELEASE

In return for being allowed to participate in Operation CARE Inc. fitness activities and all other Operation CARE related activities, conducted face to face, on social media, or via virtual platforms, the undersigned participant or Parent/Legal Guardian of participant if participant is under age 18 (hereafter referred to using “I”, “me”, or “my”) hereby grants to Operation CARE Inc., and each of its subsidiaries, affiliates, agents, advertising or promotional agencies, and partners, and all such entities’ officers, directors, agents, employees, respective successors and assigns (collectively, “Authorized Parties”), the absolute and irrevocable right and permission to use, reproduce, print, publish, broadcast and/or copyright the use of participant’s name, voice, audiotape, video recording, photograph, digital image, and/or likeness (“the Material”), and caricature or fictitious name in its current form or as retouched, digitized, cropped, altered, distorted or modified in any way, in any and all advertising, promotional, or other materials based upon or derived from the volunteer activities in any manner, in any media whatsoever for any and all purposes, including by way of example but without limitation news releases, advertising, promoting publications, marketing campaigns, media coverage, videos, Web sites, billboards, or publicizing products and services, and any other promotional or educational materials compiled by or on behalf of Operation CARE Inc. throughout the universe, in permanency, in any and all media now known or hereafter devised (including without limitation on the Internet), without compensation.

I agree that the Material may be used for any purpose consistent with the Operation CARE Inc. mission and vision.

I further agree that Material derived there from will be owned solely by Operation CARE Inc. I shall not authorize the use of any print, negative or other copy thereof by anyone other than the Authorized Parties.

I hereby release the Authorized Parties from any and all claims arising out of their use of the Material as agreed to in this document, including without limitation any claims based on the right of publicity or privacy, misappropriation or misuse of image, and/or defamation, including liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form whether intentional or otherwise. I further hereby waive any future right to prior review of any use of the Material.

I understand that this document is intended to be as broad and inclusive as permitted by the laws of the state in which the volunteer activities take place and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect.
